In Memoriam: Harold J. Rosenthal

It is with great sadness that Ostroff Associates announces the passing of our friend and associate, Hal Rosenthal, after a brave battle with pancreatic cancer. Hal was a valued and irreplaceable member of our team. His kindness, intelligence and work ethic earned the admiration of clients and colleagues alike. Hal will be deeply missed by all who knew him.

Hal joined Ostroff Associates in 2011 after over thirty years as an attorney with the New York State Department of Health. As Director of the Bureau of Litigation and prior to that as the senior staff attorney, he coordinated the representation of the Department of Health in federal and state court litigation with a special focus on health facility regulation and restructuring, including the implementation of and oversight of the defense of the recommendations of the New York State Commission on Health Care in the 21st Century (Berger Commission). He also oversaw regulatory and Medicaid reimbursement litigation addressing compliance with federal and state requirements.

Hal provided advice and counsel to Department officials as to possible actions to avoid anticipated litigation, to minimize any adverse impact of ongoing litigation and to comply with judicial decisions. He worked closely with staff of the Office of the Attorney General, the Governor’s Office, Division of the Budget and other State agencies in developing litigation strategy and responses.

Hal had a broad range of knowledge and experience with the structural and financial challenges facing New York State health care programs in an ever changing federal and state regulatory environment.  He used his expertise to find solutions for our clients on an array to health and related issues including DSRIP, managed care and other licensure, compliance and procurement matters.

Hal was a graduate of Temple University School of Law and earned his Bachelor degree from the University of Michigan. He greatly enjoyed cooking, traveling, hiking, folk music, and golf. Hal is survived by his wife Mari and his children, Mark (Elizabeth) and Liz.
